ANJANA MISHRA ORAL ORDER 02-05-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioner nos.1 and 2 are in custody since 18.07.2017 and 29.05.2017 respectively, in connection with S.T. No.367/2017 arising out of Khagaria (Muffasil) P.S. Case No.657 of 2016 (G.R. No.2439/2016) registered for the offence under Sections 341, 323, 324, 325, 307, 385, 387, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that these petitioners have been falsely implicated in this case. It is further submitted that the charge has been framed and the trial has already commenced. Learned counsel has submitted that
Patna High Court Cr.Misc. No.19165 of 2018 (3) dt.02-05-2018 2/2 the informant himself has not supported the case in his deposition.
However, after perusal of the deposition, it appears that there has been some compromise but the informant, in fact, has supported the case.
Considering the period of custody of the petitioner and that the case has now been compromised between the parties and also that the petitioners have no criminal antecedents, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Khagaria, in connection with S.T. No.367/2017 arising out of Khagaria (Muffasil) P.S. Case No.657 of 2016 (G.R. No.2439/2016). (Anjana Mishra, J) PNM U T
