JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sahebganj P.S. Case No. 10 of 2009 registered for the offence under Sections-406, 420, 467, 471 of the Indian Penal Code.
The accusation against petitioner is that she got appointment on the post of Panchayat Teacher on the basis of forged document but submission on behalf of petitioner is that the District Teacher Employment Appellate Tribunal, Muzaffarpur in Case No. 296 of 2010 has already set aside the order of concerned authorities, observing that
Patna High Court Cr.Misc. No.29038 of 2015 (2) dt.28-07-2015 2/2 the documents of the petitioner were not forged, which is evident from Annexure-3 to this petition.
Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of her arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sahebganj P.S. Case No. 10 of 2009 to the satisfaction of Learned Sub Divisional Judicial Magistrate (West), Muzaffarpur subject to conditions as laid down u/S 438(2) of the Cr. P.C.
