The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act. Allegation is that the accused persons including the petitioner tried to disturb in the election process. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The alleged occurrence is said to have taken place in course of election relating to Gram Panchayat. 20 persons were named in the F.I.R. including the petitioner. No specific injury has
Patna High Court Cr.Misc. No.54178 of 2016 (2) dt.20-12-2016 2/2 been attributed against the petitioner. Due to political reason the petitioner has been made accused in the present case. The other co-accused have been granted anticipatory bail vide Cr.Misc.No.52534 of 2016, Cr.Misc.No.41741 of 2016, Cr.Misc.No.37952 of 2016, Cr.Misc.No.37827 of 2016 and Cr.Misc.No.36924 of 2016.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, East Champaran at Motihari in connection with Pakridayal P.S. case No.51 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
