JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-05-2017 Heard learned counsel for the petitioners and learned APP representing the State.
The petitioners seek bail in connection with Khagaria P.S. Case No. 701 of 2016 registered for the offences punishable under Sections 8/20(b) (ii) (B) of Narcotic Drugs & Psychotropic Substances Act.
Allegedly, 14 kg. and 800 Grams Ganja was recovered from possession of the petitioners and for that no paper was produced.
Submission is of false implication and that mandatory provision of Section 50 of the N.D.P.S. Act has not been followed, nothing was recovered from conscious possession of the petitioners and they have been made victim of circumstances.
Patna High Court Cr.Misc. No.19320 of 2017 (2) dt.18-05-2017 Learned APP opposes the prayer of bail.
In the facts and circumstances stated above, considering the alleged recovery, this Court is not inclined to enlarge the petitioners on bail, accordingly, their such prayer stands rejected.
