The petitioner seeks bail in anticipation of his arrest in connection with Bakhtiyarpur P.S. Case No. 174 of 2020 instituted for the offences punishable under Sections 341, 323, 504, 506, 307, 379 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the injuries on the informant are not corroborated which has been made in the FIR registered by him. Learned counsel submits that the injuries in the FIR states that the injury being suffered by a sword and has lacerated wound.

In view thereof, it is a case of over implication and the petitioner deserve to be granted bail.

I have considered the submissions and taking into

No.49107 of 2021(2) dt.15-02-2022 2/2 consideration the overall aspect and the fact that the allegations against the petitioner was of using sword, I am inclined to allow the petitioner on bail, in the event of arrest he shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
