The petitioner has preferred this application for grant of regular bail in connection with Udwantnagar P.S. Case No. 52 of 2022 dated 05.02.2022 registered u/s 20(b), (ii)(b) and 29 of the N.D.P.S Act.

As per the prosecution case, total 4.26 kg ganja like substance was recovered from the house of the petitioner. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The seized contraband is less than commercial quantity. The other co-accused person has already been granted bail by

Patna High Court CR. MISC. No.42399 of 2024(2) dt.20-07-2024 2/2 this court vide order dated 29.03.2023 passed in Cr. Misc. No. 62618 of 2022. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.02.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Udwantnagar P.S. Case No. 52 of 2022.

The application stands allowed.
