The petitioner seeks bail in anticipation of his arrest in connection with Rajauli P.S. Case No. 321/2020 instituted for the offences under Sections 30 (a), 41 and 52 of the Indian Penal Code.

It appears from the prosecution report that one Birbal Rajvanshi was arrested and an oven for preparing / brewing liquor was unearthed. Aforesaid Birbal Rajvanshi

Patna High Court CR. MISC. No.38054 of 2020(2) dt.16-04-2021 2/3 is said to have named the petitioner. There is recovery of 60 litres of country made liquor and three motorcycles; two of which did not have any registration number. Learned counsel for the petitioner has submitted that he was not arrested on the spot and his implication in this case is only on the basis of the statement of coaccused Birbal Rajvanshi. The petitioner has got no concern with whatever has been seized during the course of the raid.

It further appears from paragraph - 3 of the bail petition that petitioner does not have criminal antecedents. Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge, Nawada, in connection with Rajauli P.S. Case No.
