The appellant seeks pre-arrest bail in connection with Belaganj P.S. Case No. 112 of 2019 registered under Sections 147, 149, 341, 323, 307 and 504 of the Indian Penal Code and Section 3(i) (r) (w) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Submission of learned counsel for the appellant is that the appellant is quite innocent and has falsely been implicated in the present case due to village politics. There is general and omnibus allegation against the appellant. Further submission is that the appellant has no criminal antecedent. Learned Special P.P. appearing on behalf of the

APP (SJ) No.2294 of 2019 dt.18-06-2019 2/2 State vehemently opposed the prayer of the appellant by contending that there is direct allegation against the appellant of assault by means of Khanti on the head of the informant, as a result of which, she sustained injury and became unconscious. Having considered the facts and circumstances of the case and the submissions advanced on behalf of both the parties, I am not inclined to allow the prayer of the appellant for grant of anticipatory bail.

Accordingly, the appeal is dismissed.
