The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 379, 504, 506 of the Indian Penal Code. Charge sheet has been submitted under Sections 341, 323, 337, 308, 504, 506 of the Indian Penal Code. As per allegation in the FIR, petitioners along

Patna High Court CR. MISC. No.40344 of 2022(3) dt.04-01-2023 2/3 with other co-accused persons assaulted the informant with lathi and bricks due to which informant sustained injuries. It is also alleged that petitioner Sarwan Kumar Singh lashed with pistol threatened to kill the informant and he also snatched Rs. 10,000/- from the informant. It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case. It is also submitted that petitioners are languishing in judicial custody since 04.04.2022. It is further submitted that due to land dispute the present case has been registered with false and concocted allegations. It is also submitted that injury sustained by the informant is simple in nature and caused by hard and blunt substance.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and

The above named petitioners are directed to be enlarged on bail in connection with Atri P.S. Case No. 136 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. XIII, Gaya.
