The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code. The informant alleged that the petitioners knowingly dashed him causing fracture injury and thereafter the petitioners took out Rs. 20,000/- from his pocket.
It is submitted that the occurrence took place on 20.03.2015 but the FIR was lodged on 22.03.2015. The informant is own brother of petitioner No.2 and on account of land dispute this false case has been lodged.
Considering the nature of allegation made against the petitioners and the fact that both the petitioners dashed the
Patna High Court Cr.Misc. No.24949 of 2015 (2) dt.10-07-2015 2/2 informant with their jeep causing fracture injury, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
