1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 74, 79, 126(2), 117(2), 115(2), 351(2), 352, 191(2), 190 and 109 of the BNS.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent. It is next submitted that Pawan Kumar along with seven others had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 17421 of 2026 and the same came to be allowed by an order dated 18.04.2026 after considering the case in detail and on merits. It is further submitted that as far as these petitioners are concerned, no specific allegation of assault

Patna High Court CR. MISC. No.42838 of 2026(2) dt.31-07-2026 2/2 is alleged. It is thus submitted that case of the petitioners are on a better footing than petitioner nos. 1, 3 and 8 of Criminal Miscellaneous No. 17421 of 2026.

4. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioners.

5. Considering the submissions made by the learned counsel for the petitioners and taking into consideration the order dated 18.04.2026 in Criminal Miscellaneous No. 17421 of 2026, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Phesar P.S. Case No. 167 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
