JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 448, 341, 323, 325, 307, 308 and 380 of the Indian Penal Code.
The prosecution story, in brief, is that on 12.5.2014 Renu Devi stopped the flow of water which was objected by the informant then FIR named accused persons having Lathi and Danda in their hands came assaulted her and entered in her house and took away box and cash and due to assault the informant became unconscious and other persons have brought her to hospital for medical treatment.
Patna High Court Cr.Misc. No.26236 of 2015 (2) dt.21-07-2015 2/2 On behalf of the petitioners, it is submitted that due to petty matter scuffle has taken place. It is further submitted that the alleged date of occurrence is 12.5. 2014 and the present case was instituted on 12.6.2014, after a period of one month. It is further submitted that from perusal of the impugned order it appears that the investigating officer has made all efforts to obtain injury report of the informant but same could not be obtained.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.K.Manjhi, Judicial Magistrate, 1st Class,Saharsa in connection with Bihra P.S.Case No. 101 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
