Petitioner seeks bail in Hussainganj P.S. Case No.249 of 2020 registered under Sections 272, 273 of the IPC and under Sections 30(a), 41(i) of the Bihar Prohibition and Excise Act. The police after having received secret information searched the house of the petitioner and altogether 126.2 litres of liquor kept in different pouches was recovered from the house of the petitioner.

It is submitted that the petitioner is in jail since 10.09.2020. The petitioner has already remained in jail for about five months.

Having considered the facts that for recovery of 126.2 litres of liquor the petitioner has already remained in jail for about five months and he has got no criminal antecedent, the
