JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chainpur Police Station Case No. 60 of 2015 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Petitioner happens to be rice mill owner and accusation against him is that he did not supply rice as per agreement and accordingly, misappropriated huge government money but submission on behalf of the petitioner is that according to agreement, in case of failure of supply of rice, the corporation may institute certificate case for realization of amount. It is contended on behalf of the petitioner that all most on similar facts,
Patna High Court Cr.Misc. No.24645 of 2015 (2) dt.13-07-2015 2/2 several cases have been registered and several accused of those cases have been granted privilege of anticipatory bail by different Benches of this Court.
Accordingly, it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua in Chainpur Police Station Case No. 60 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
