Petitioner being husband of the deceased is languishing in jail custody since 22.2.2016 in a case initially, registered under sections 328 and 302/34 of the Indian Penal Code but after investigation, police submitted charge sheet under section 306/34 of the Indian Penal Code.

It would appear from perusal of the case diary that in course of investigation, it came to light that the petitioner had illicit relation with his Bhabi and he was a drunkard which caused annoyance to the deceased who, later on, committed suicide.

The fardbeyan of the informant goes to show that deceased was taken to hospital by the petitioner and his family members and after that informant got information regarding condition of the deceased by nephew of the petitioner.

Patna High Court Cr.Misc.
