The petitioner seeks bail in Bihta P.S. Case No. 461 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Total 128.160 litres of foreign liquor has been recovered from two motorcycles out of which 67.680 litres has been recovered from the motorcycle which was being driven by this petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. Motorcycle in question does not belong to this petitioner. Petitioner claims clean antecedent and he is in custody since 08.07.2021. Investigation is complete.

No.49154 of 2021(2) dt.24-11-2021 2/2 Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with BihtaP.S. Case No. 461 of 2021.
