JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 366 A of the Indian Penal Code.

No doubt, petitioner is named in the first information report with allegation of kidnapping of minor grand daughter of the informant but Para-65 of the case diary goes to show that the victim was recovered at Village-Manjhriya on 30.11.2015 and after that her statement was recorded under Section 164 of the Cr.P.C. on 01.12.2015. The victim disclosed her age as 20 years whereas the learned Magistrate assessed her age as 16 years. The

Patna High Court Cr.Misc. No.27525 of 2016 (3) dt.16-09-2016 2/2 victim stated that she was forcibly taken away by the petitioner but she has not made any complaint of ill-treatment upon her by the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sitesh Kumar, Judicial Magistrate 1st Class, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 127 of 2015.
