The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 394 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the similarly situated co-accused Jai Chand Mahto has been granted privilege of regular bail by a coordinate Bench of this Court in Cr. Misc. No. 42359 of 2016 dated 04.10.2016. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his payer for anticipatory bail is rejected in connection with Sandesh P.S. Case No. 38 of 2016 pending before the court of the learned Additional Chief Judicial

Patna High Court CR. MISC. No.36282 of 2019(3) dt.14-08-2019 2/2 Magistrate-IX, Bhojpur (Arrah).

Accordingly, the application is dismissed.

However, petitioner is directed to surrender before the learned court below and if he does so and makes prayer for bail, the learned court below shall grant bail to the petitioner on the same day.
