JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Sessions Trial No. 787 of 2013 (arising out of Kasimbazar P.S. Case No. 13 of 2013) registered under Section 364 of the Indian Penal Code. Learned counsel for the petitioner submits that in the present case, the petitioner was granted bail on 10.01.2014 vide Criminal Misc. No. 26909 of 201. Due to none appearance of the petitioner before the trials court on 10.09.2014 his bail bond was cancelled. Further submission is that the petitioner was apprehended by the police in Kharagpur P.S. Case No. 163 of 2014 on 19.07.2014 and granted bail on 10.11.2014 due to that
Patna High Court Cr.Misc. No.31582 of 2016 (2) dt.10-08-2016 reason he could not appear on 10.09.2014. As such, the misuse of privilege of bail was not intentional by the petitioner. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger, in connection with Sessions Trial No. 787 of 2013 (arising out of Kasimbazar P.S. Case No. 13 of 2013). Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and further the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
