2. The present application has been filed for quashing the order dated 17.05.2023 passed by the learned Additional District Judge-III, Lakhisarai in S.T. No. 509 of 2011 arising out of Lakhisarai P.S. Case No. 317 of 2003 by

Patna High Court CR. MISC. No.43414 of 2023(9) dt.08-07-2025 2/2 which petitioners were summoned for facing trial as per provision available under Section 319 of Cr.P.C.

3. It is pointed out by Mr. Jharkhandi Upadhyay, learned APP appearing for the State that several witnesses examined in this matter and, therefore, now there is no occasion to interfere with impugned order.

4. Considering the submission, which could not disputed by learned counsel for petitioners, the present petition appears devoid of any merit, accordingly same stands dismissed.
