Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 20, 21, 22, 23 of the N.D.P.S. Act.
From the joint house of co-accused Lalan Singh and Rajeev Singh 10 Kg Ganja and 10 Kg green Ganja plant were recovered which were uprooted and seized. The apprehended accused suggested the name of the petitioner and others who delivered the Ganja.
It is submitted by learned counsel for the petitioner that admittedly recovery has been made from the house of co-accused Lalan Singh and Rajeev Singh who have been granted bail vide Cr. Misc. Nos. 14435 of 2015 and 17228 of 2015.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.23879 of 2015 (2) dt.29-06-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Darbhanga in connection with Bahera P.S. Case No. 559 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. If the investigation has already not been concluded, then bail bonds of the petitioner shall be accepted on filing affidavit that he will cooperate in the investigation. Non-cooperation in the investigation will give liberty to the learned Court below to cancel the bail bonds of the petitioner. (Dinesh Kumar Singh, J) Shageer/- U T
