JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Saharsa (Sadar) PS case no. 43 of 2018 instituted for the offences punishable under Sections 363, 364, 365, 120B of Indian Penal Code.
The allegation is regarding the wife of the informant having gone to her maternal grandmother's house, who was ill, however she did not return thereafter. The learned counsel for the petitioner submits that there is no material on record whatsoever to connect the petitioner with the alleged occurrence and merely on suspicion, the petitioner has been implicated in the present case. Patna High Court Cr.Misc. No.21111 of 2018 (3) dt.17-05-2018 2/2 submitted that the petitioner is languishing in custody since 25.01.2018 and is having a clean antecedent. It is further submitted that the petitioner is ready to abide by whatsoever condition as may be imposed by the Hon'ble Court. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Saharsa in connection with Saharsa (Sadar) PS case no. 43 of 2018.
It is further directed that the petitioner shall mark his presence before the officer-in-charge of the concerned police station at 10 am on every Monday and in case of failure to do so on two consecutive occasions, the present privilege of bail shall stand cancelled automatically. It is needless to state that petitioner shall continue to appear before the officer-in-charge of the concerned police station as aforesaid till the framing of the charges against the accused persons.
