The petitioner is apprehending his arrest in a case registered under Sections 420 and 406 of the Indian Penal Code. The allegation against the petitioner is of committing the offence of cheating as well as forgery with the informant and other persons by making fake company and by giving an assurance to depositors to give certain interest on their deposits and after certain period to return their original deposited amount, but not returned the deposit of the depositors and closed the alleged company.
On behalf of the petitioner, it has been submitted that the petitioner is employee of the company. He is not the
Patna High Court Cr.Misc. No.23891 of 2015 (3) dt.02-09-2015 2/2 beneficiary to the loss caused to the informant. It has been further submitted that the petitioner is ready to deposit an amount of Rs.10,000/- in the court below, which shall be subject to the final disposal of the case.
On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, the above named petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in Basantpur P.S. Case No.288 of 2014, subject to the conditions laid down under section 438(2) Cr.P.C. and with further condition that the petitioner shall deposit an amount of Rs.10,000/- in the court below, which shall be subject to the final disposal of the case.
