The petitioner has preferred this application for grant of regular bail in connection with Sitamarhi Cyber P.S Case No. 33 of 2024 dated 31.03.2024 registered for the offence punishable under Section 255, 406, 420, 467, 468, 471, 120(B) of the Indian Penal Code and Sections 66(c) and 66(D) of Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have committed forgery in withdrawing money from the Bank Account of innocent people

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is also submitted that from perusal of the FIR it will manifest that the name of the petitioner has transpired on the confessional statement of the co-accused Ramesh Kumar which has got no evidentiary value in the eye of law. Nothing is recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The similarly situated co-accused person has been granted bail vide order dated 10.07.2024 in Cr. Misc. No. 39116 of 2024. The petitioner is a person with clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.04.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Sitamarhi Cyber P.S. Case No. 33 of 2024.
