The petitioner seeks bail in Mahila P.S. Case No. 52 of 2019 corresponding to Sessions Trial No. 54/21/07/21, registered for the offence punishable under Section 376(D) of the Indian Penal Code.

Earlier the bail application of petitioner was rejected vide order dated 29.01.2021. Vide order dated 01.09.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'A'), which reveals that out of eight prosecution witnesses, one prosecution witness has been examined and case is fixed for prosecution evidence. Considering the nature of accusation and stage of trial, I am not inclined to enlarge the petitioner above-named on

Patna High Court CR. MISC. No.49593 of 2021(3) dt.27-10-2021 2/2 bail. Accordingly, the same is rejected.

However, trial court is directed to conclude the trial as early as possible, as the petitioner is in custody since 18.03.2020.
