JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections 147, 148, 149, 341, 323, 452, 427, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Petitioners are named in this case on the accusation that they along with others went at the door of the informant and made indiscriminate firings and also lobbed bombs and furthermore, they, having entered into the house of the informant, not only assaulted the inmates of the house but also committed theft belonging to the informant.
Submission on behalf of the petitioners is that having
Patna High Court Cr.Misc. No.33870 of 2016 (2) dt.18-08-2016 2/2 more or less similar allegation, several co-accused have already been granted privilege of bail and so far as criminal antecedent of the petitioners is concerned, there is long standing enmity between the petitioners and prosecution party and almost all the cases, which had been lodged against the petitioners, were filed by the prosecution party.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Bhagalpur in connection with Ishakchak (Tilkamanjhi) P.S. Case No.5 of 2016.
