The petitioner seeks bail in Gopalganj Town P.S. Case No. 665/2018, instituted for offence under Section(s) 420, 406, 337, 384, 323/34 of the Indian Penal Code read with Section 138 of N.I. Act.

Learned counsel for petitioner has submitted that informant has not produced any document in support of allegation demonstrating that petitioner has handed over to him any paper alleged to be fake. Allegations are vague and omnibus. No specific allegation has been attributed against the petitioner. It is alleged in the written report that money was given to the petitioner by 19 candidates. It is alleged that petitioner gave fake Visa of Cyprus and Dubai and asked to make payment of rest amount immediately. The accused persons cancelled the Visa and

Patna High Court CR. MISC. No.39554 of 2019(3) dt.27-08-2019 2/2 became traceless. The informant approached the office of Md. Sohel. Thereafter a Panchayati was conducted. The accused persons assured to give money. The petitioner gave cheque to the informant but there was no amount in his account. Learned counsel for petitioner has submitted that detail of money is not mentioned in the written report. Only vague and omnibus allegation has been levelled against the petitioner by the complainant.

Petitioner is in custody since 04.04.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No. 665/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
