The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.

The allegation against the accused including the petitioner is that due to non-fulfillment of demand of dowry, the sister of the informant was subjected to torture in various ways and ultimately, she was killed.

On behalf of the petitioner, it is submitted that the petitioner has got no criminal antecedent. He has falsely been implicated in the present case. There is no direct evidence against the petitioner. The present case is in retaliation to the

Patna High Court Cr.Misc. No.23776 of 2015 (3) dt.02-09-2015 2/2 Annexure-2 which was instituted by the petitioner's side against the informant and others.

On behalf of the State, it is submitted that the petitioner is the husband of the deceased.

Considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner and the same is rejected.

However, if the petitioner surrenders in the court below within a period of four weeks, the same shall be considered on its own merit without being prejudiced by this order. (Sudhir Singh, J) V.K. Pandey/- U T
