JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case for the offences punishable under Sections 399, 402, 307, 216(A) of the Indian Penal Code, Sections 25(1-b), 26, 27 and 35 of the Arms Act. Petitioner is in jail custody since 16.8.2015 under accusation that he along with others were planning to commit loot and murder and when petitioner was caught, one country made loaded pistol and four live cartridges were recovered from his conscious possession. Petitioner does not have any criminal antecedents except two cases are pending against him. Considering the aforesaid facts and circumstances as well as submissions of the parties as also the period of detention of

No.29671 of 2016 (2) dt.27-07-2016 2/2 the petitioner in this case, let him be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sitamarhi, in connection with Majorganj P.S. Case No. 169 of 2015, G.R. No. 2480 of 2015.
