The petitioners seek bail in anticipation of their

Patna High Court CR. MISC. No.39297 of 2020(2) dt.08-12-2021 2/3 arrest in connection with Marhowrah P.S. Case No. 534 of 2019 dated 03.08.2019 instituted for the offences under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.

The petitioners are alleged to have obtained appointment as teachers on fake and forged certificates regarding their academic qualification. The aforesaid facts were disclosed only after an order was passed in a PIL petition before this Court, which had directed for an inquiry in the matter.

Mr. Sinha, learned senior advocate for the petitioners submits that under similar circumstances many other teachers, whose certificates were found to be forged, have been granted the privilege of anticipatory bail by a Bench of this Court.

The petitioners have been removed from service and are facing prosecution.

There is no material on record to justify any custodial interrogation of the petitioners as the

Patna High Court CR. MISC. No.39297 of 2020(2) dt.08-12-2021 3/3 investigation primarily veers around finding out the process by which fake certificates were obtained and made use of for the purposes appointment in government job.

Considering the aforenoted submissions raised on behalf of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran, Chhapra in connection with Marhowrah P.S.
