Mr. Sri Ram Bachan Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-05-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Parbatta P.S. Case No. 430 of 2017, registered for the offence punishable under Sections 25(1-A), 25(1-AA), 25(1-B)a, 25(1B)e, 26 and 35 of the Arms Act. The allegation is regarding recovery of one pistol and five cartridges from the possession of the petitioner. It is further alleged that some other articles, which are used in manufacturing arms, have been recovered from the house of the co-accused.

The learned Counsel for the petitioner submits that the petitioner has been falsely implicated in the present case

Patna High Court Cr.Misc. No.20637 of 2018(3) dt.17-05-2018 2/2 and he is in custody since 06.12.2017. It is further submitted that barring one case in which the petitioner is on bail, the petitioner is otherwise having a good antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Khagaria in connection with Parbatta P.S. Case No. 430 of 2017.
