Heard learned counsel appearing on behalf of petitioner and learned A.P.P. for the State.

This application is filed for Modification of order dated 12.06.2020 passed in Criminal Miscellaneous No. 14082 of 2020.

Learned counsel appearing on behalf of the petitioner submits that vide order dated 12.06.2020 passed in Criminal Miscellaneous No. 14082 of 2020, the petitioner was directed to be released on bail in the event of his arrest or surrender before

No.9024 of 2021(2) dt.24-02-2021 2/2 the court below within the period of four weeks on furnishing the bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of the learned Additional District Judge-II-cum-Special Judge, Excise, Buxar, or the successor Court, in connection with Brahmpur (Nonijor) P.S. Case No. 378 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C., but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated period.

In such view of the matter, the time to surrender of petitioner, as per order dated 12.06.2020 passed in Criminal Miscellaneous No. 14082 of 2020, is further extended by six weeks from today in connection with aforesaid case. Accordingly, the modification application is allowed and the order dated 12.06.2020 passed in Criminal Miscellaneous No. 14082 of 2020 is modified to the above extent.
