The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.
It is alleged that the petitioners came to the grand-mother's house of the victim and took her in the company of Ranjeet Kumar and Pintu Kumar.
It is submitted by the learned counsel for the petitioners that under Section 164 Cr.P.C. statement the victim got her age recorded as 19 years whereas the court assessed her aged 18 years, where she has stated that she of her own married with co-accused Ranjeet Kumar and she wants to reside with her husband. In 164 Cr.P.C. statement the victim has not named
Patna High Court Cr.Misc. No.23836 of 2015 (2) dt.26-06-2015 the petitioners. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhagalpur in connection with Bath P.S. Case No. 33 of 2014, G.R. No. 1790 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
