JUSTICE SUDHIR SINGH ORAL ORDER 28-10-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Rajgir P.S. case No.248 of 2015 (S.T. No.296 of 2016) instituted for the offence under Section 392 of the Indian Penal Code, pending in the court of learned A.D.J. VII, Biharsharif, Nalanda.

Allegation is that four unknown persons on the point of sticks and pistol snatched the bags of silver jewellary amounting to Rs.7 lacs from the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.3.2016 and the charge sheet has been submitted in the case. The petitioner is not named in the F.I.R. His name has come on the confessional statement of the coaccused.

Patna High Court Cr.Misc. No.37291 of 2016 (3) dt.28-10-2016 2/2 On behalf of the State, it is submitted that the petitioner has been put on Test Identification Parade. He has been identified by the informant. The recovered article has also been put on Test Identification Parade. There are two other cases pending against the petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to expedite the trial and conclude the same within a period of nine months from the date of receipt/production of a copy of this order. The District Magistrate, Nalanda at Biharsharif and the Superintendent of Police, Nalanda at Biharsharif are also directed to ensure that the prosecution witnesses are produced in the court on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Nalanda at Biharsharif and the Superintendent of Police, Nalanda at Biharsharif.
