JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Kudra P.S. Case No. 40 of 2017, registered under Section 20(b)(ii)(a), 27(A) of the NDPS Act and 30(a),38(1)(2) of the Bihar Excise Act, 2016.

The accusation is that on receiving secret information about selling of the Ganja by Vicky Singh and his mother Punam Devi (Petitioner) at their residential house in Babu Mohalla, Kudra, the Police reached there. On search of house, a bag containing 3 Kg 400 gram and 71 pouches containing 300 gram of Ganja and 8 bottles, each containing 180 ML India made foreign liquor recovered. One person was also apprehended, who disclosed his name as Vicky Singh and

Patna High Court Cr.Misc. No.18626 of 2017 (2) dt.05-05-2017 2/2 disclosed that he used to sell the Ganja and liquor in connivance with her mother Punam Devi (Petitioner).

Learned counsel for the petitioner submits that petitioner is the mother of co-accused Vickey Singh due to that reason, she has been implicated in this case. Further submission is that petitioner has no criminal antecedent is in custody since 12.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge N.D.P.S. Act, Kaimur at Bhabua in connection with Kudra P.S. Case No. 40 of 2017.
