JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 24-11-2023 Heard Mr. (Dr.) Sanjay Kumar Singh learned counsel appearing on behalf of the petitioners; Mr. Uday Prasad learned AC to GP 22 for the State and Mr. Shailendra Kr. Singh, learned counsel for the BSFC.
2. Learned counsel appearing on behalf of the petitioners submits that due to inaction on part of the District Co-operative Officer, Madhepura, the payment has not been made by the Chairman of the concerned PACS to the petitioners. He further submits that in similar matter, vide order dated 21.01.2019, passed in CWJC No.1251 of 2019, this Court has directed the concerned District Co-operative Officer to release the required fund, so that payment can be made to the petitioners.
3. Considering the aforesaid submissions, the District Co-operative Officer, Madhepura is directed to ensure that the claim of the petitioners must be redressed by making payment of the required amount for the supply of the grains into the account of the petitioners.
4. The above exercise is directed to be completed
Patna High Court CWJC No.9325 of 2023 dt.24-11-2023 3/3 within a period of three weeks from the date of production of a copy of this order by the petitioners.
5. In case of failure on part of the District Cooperative Officer, the Additional Chief Secretary of the concerned Department is directed to take disciplinary action against him/her in accordance with law.
6. With the above observation/direction, the present writ petition is disposed of.
