Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 427 and 435 of the Indian Penal Code.
The prosecution case is that police reached to the place of occurrence on information that miscreants are assaulting the passengers of a public vehicle when the petitioner was apprehended, but due to the protest and furious attitude of the miscreants police had to release the petitioner.
It is submitted by the learned counsel for the petitioner that due to the protest made by the public against the high handedness of the police, the present case has been
Patna High Court Cr.Misc. No.23825 of 2015 (2) dt.26-06-2015 lodged and the petitioner was never apprehended by the police. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Barhariya P.S. Case No. 501 of 2014, pending in the court of learned Chief Judicial Magistrate, Siwan.
With the above observation this application is disposed of.
