JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-06-2015 Heard learned counsels for the petitioner and the State. The petitioner being Headmaster of the Middle School, Khamkoul is apprehending arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

The accusation against the petitioner is of misappropriating the funds to the tune of Rs.9,35,631 pertaining to three schemes i.e. scheme nos. 1/2011-12, 2 of 2011-12 and 3 of 2011-12.

It is submitted by the learned counsel for the petitioner that the petitioner subsequently deposited Rs.6,75,000 in the school account on 13.2.2015 and the petitioner is ready to deposit

Considering the present stand of the petitioner, let the above named petitioner be released on provisional anticipatory bail for six months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S. Case No. 61 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The learned court below will confirm the provisional bail of the petitioner if the petitioner filed substantive proof with regard to the deposit of the alleged entire amount in the school account.
