The petitioner is in custody in connection with Trial No.08 of 2020 arising out of Gopalganj Town P.S. Case No. 231 of 2020, for the offence under Sections 8(c) and 21(a) of the Narcotic Durgs and Psychotropic Substances Act. In the instant case, 4.860 grams of smack was seized from the pocket of the pant of the petitioner. Petitioner is in custody since 25.04.2020.

Considering the fact that the petitioner is in custody since 25.04.2020 and quantity of smack is 4.860 grams only, the Court is inclined to grant bail to the petitioner subject to the condition that the petitioner has to deposit Rs.1,00,000/- in cash.

No.36782 of 2020(2) dt.01-02-2021 2/2 On depositing the amount of Rs.1,00,000/-, petitioner, abovenamed, shall be released on bail on furnishing bail bond of Rs. 1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judgecum-Special Judge, N.D.P.S., Gopalganj in connection with Trial No.08 of 2020 arising out of Gopalganj Town P.S. Case No. 231 of 2020.

Deposit of Rs.1,00,000/- (Rupees one lakh) shall abide by final outcome of Trial No.08 of 2020 arising out of Gopalganj Town P.S. Case No. 231 of 2020.
