Patna High Court C.Misc. No.484 of 2022(2) dt.10-11-2022 2/2 ORAL ORDER 10-11-2022 By the impugned order dated 27-04-2022 passed in Misc. Appeal No. 04 / 2021 status quo has been granted with regard to the suit property. Injunction has been granted directing both the plaintiffs as well as the defendants to maintain status quo with regard to suit property.

The petitioner while assailing the order of injunction granted by the learned lower appellate court in Misc. Appeal No. 04 / 2021 submits that while granting status quo lower appellate court failed to consider the fact that all the defendants were not made party in the Miscellaneous Appeal and only plaintiffs and some other defendants were party. It is admitted position that the suit is for partition and both the parties have been directed to maintain status quo.

I do not find any material irregularity and / or jurisdictional error in the impugned order granting status quo. There is no merit in this application.

The petition stands dismissed.
