Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201, 120B/34 of the Indian Penal Code.
It is alleged by the informant that his son informed him that wife of the informant was killed by petitioner along with other co-accused because wife of the informant protested illicit relationship of her sister Rajo Devi with one Ashok Kumar Singh, A.S.I.
It is submitted by learned counsel for the petitioner that on completion of the investigation, accusation has been found false and final form was submitted but differing with the final form, cognizance was taken on 06.11.2012. It is submitted by learned counsel for the State that final form was submitted since A.S.I was accused in
Patna High Court Cr.Misc. No.23868 of 2015 (2) dt.29-06-2015 2/2 the present case.
Considering the fact that petitioner was named in the First Information Report and cognizance was taken on 06.11.2012, this Court is not inclined to entertain the present anticipatory bail application.
Let learned Court below consider the prayer for bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Noorsarai P.S. Case No. 154 of 2011, pending in the Court of learned Chief Judicial Magistrate, Nalanda at Biharsharif.
With the observations above, the application stands disposed off.
