2. The petitioner has preferred this application for grant of regular bail in connection with Mahila P.S. Case No. 01 of 2024 dated 22.01.2024 registered for the offence/s punishable u/ss 341, 342, 323, 325, 354B, 307, 379 of the Indian Penal Code and section 3 and 4 of the Prevention of Witch (Diaan) Practices Act, 1999 and later on added section 302 of the IPC
3. As per the prosecution case, the petitioner and the co-accused persons armed with deadly weapons are alleged to
Patna High Court CR. MISC. No.42026 of 2024(2) dt.20-06-2024 2/3 have entered the house of the informant and the petitioner assaulted her with legs and fists and started pressing her neck. It is further alleged that the co-accused Bhagirath Prasad assaulted the informant on her hand with iron rod causing fractured injury. Thereafter, the other accused persons also assaulted the informant's family members who came to rescue her and took out iron and watch.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a lady. The allegation against the petitioner is of assaulting the informant with legs and fists. There is general and omnibus allegation against the petitioner. It is further submitted that no any external injury was found on the neck of the informant/deceased. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 27.01.2024.
5. Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. The specific allegation of assault on the hand of the deceased is against the co-accused Bhagirath Prasad and the injury is grievous in nature.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.42026 of 2024(2) dt.20-06-2024 3/3 of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Mahila P.S. Case No. 01 of 2024.
7. The application stands allowed.
