This application is for grant of bail in connection with Sasaram (T) P.S.Case No.1139 of 2016 for the offence under Section 366 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case only on the basis of suspicion and nothing else has come against this petitioner. It is further submitted that the C.D.R. only shows that he has talked with the victim girl but apart from that nothing is there. The petitioner is in custody since 07.10.2016.
Heard learned A.P.P. also, who has opposed the prayer for bail, stating that in Para-9 of the Case Diary, there is specific
Patna High Court Cr.Misc. No.4290 of 2017 (3) dt.17-03-2017 2/2 allegation against the petitioner and the C.D.R. also shows that there was talk between the petitioner and the victim girl, just prior to occurrence. The victim girl is still traceless. Having heard both sides and in view of the facts aforesaid, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months.
With the aforesaid observation, this application is dismissed.
