The petitioners seek bail in connection with Sare P.S. Case no. 46 of 2017 registered under Section 365 of Indian Penal Code.

Nephew of the informant is said to have been murdered and his dead body was dumped in the well located adjacent to the house of the petitioners.

It is submitted by learned counsel for the petitioners that the petitioners are innocent and have no concern with the aforesaid occurrence. They have been falsely implicated in this case merely on suspicion. The well from where the dead body is said to have been recovered is in abandoned house though

Patna High Court Cr.Misc. No.21381 of 2018(3) dt.23-05-2018 2/2 located adjacent to the house of the petitioners. There is nothing cogent in record indicating complicity of the petitioners in the occurrence. They have been languishing in custody since 03.04.2017. Similarly situated co-accused, namely, Santosh Kumar @ Santosh Singh has been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 27.11.2017 passed in Cr. Misc. no. 39651 of 2017. In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of the learned A.D.J. 3rd, Biharsharif, Nalanda in connection with Sare P.S. Case no. 46 of 2017.
