2. The petitioners are apprehending their arrest in connection with Muffasil P.S. Case No. 129 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 324(4) 352, 351(2), 303(2), 3(5) of the BNS, 2023.

3. Allegedly in the morning of the fateful day while the informant was sitting in his mobile shop, in the meanwhile

Patna High Court CR. MISC. No.39151 of 2026(2) dt.17-06-2026 2/3 six named accused persons along with 5 unknown persons, including the petitioners, variously armed came there and started threatening and hurling abuses. When the informant objected for the same, in the meanwhile, co-accused Chandan Yadav whipped up his knife and assaulted over his head due to which he sustained serious injury, whereupon other accused persons also assaulted him by fists, slaps, lathi and danda. There is further allegation against co-accused persons of snatching of valuables.

Learned Advocate for the petitioners taking this Court through the FIR submitted that the specific accusation of causing knife blow is alleged against co-accused Chandan Yadav, who is not before this Court. So far the injury is concerned, the impugned order suggests that the injured has sustained one injury over his head, which is vital part of the body and may be dangerous to life but as per his instruction, the injury is simple in nature as has been stated in paragraph 7(ii). The reason behind the said occurrence is said to be a trifle leading to free fight resulted into some unfortunate injury. The petitioners are men of fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.

5. On the other hand, learned Advocate for the State

Patna High Court CR. MISC. No.39151 of 2026(2) dt.17-06-2026 3/3 vehemently opposed the bail application and submitted that the petitioners have actively participated and brutally assaulted the informant which resulted into serious injury.

Having considered the submissions advanced on behalf of the learned Advocates for the respective parties and taking note of the omnibus nature of allegation against the petitioners and the injury appears to be simple in nature, though on vital part, coupled with the fair antecedent of the petitioners, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in connection with Muffasil P.S. Case No. 129 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
