JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Kahalgaon P.S. Case No. 35 of 2016, registered for the offences punishable under Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

Allegedly, the petitioner was apprehended and from his possession one country made katta, cash of Rs. 910/- and one live cartridge were recovered and further from pistol one fired cartridge was also recovered.

Submission is of false implication and that the petitioner has been made victim of the circumstances. He is suffering in custody since 29.1.2016 and by remaining in custody

Patna High Court Cr.Misc. No.3527 of 2017 (2) dt.28-02-2017 has been sufficiently penalized.

The learned A.P.P. fairly submits that now the petitioner has remained in custody for sufficient period. In the facts and circumstances stated above, the petitioner, namely, Sanjay Kumar Verma, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S. Case No. 35 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
