JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Banka SC/ST P.S. Case No. 07 of 2016, registered under Sections 366(A), 504, 506/34 of the Indian Penal Code and Section 3(I),(X), (XI) of the SC/ST Act.

The accusation is of kidnapping of daughter of the informant by the petitioner with the help of his family members for the purpose of marriage.

Learned counsel for the petitioner submits that, in fact, victim daughter of the informant left the house according to her sweet will and performed marriage with this petitioner and she started to live her conjugal life with the petitioner. Further

Patna High Court Cr.Misc. No.27603 of 2016 (2) dt.11-07-2016 2/2 submission is that the statement under Section 164 Cr.P.C. of the victim was recorded in which Court has assessed her age as 17 years and she has stated that she left her house according to her sweet will and she performed marriage with this petitioner in Kamla temple and she want to live with her husband and inlaws. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Banka in connection with Banka SC/ST P.S. Case No. 07 of 2016. (Rajendra Kumar Mishra, J.) manish/- U T
