The petitioners seek bail in a case registered under Sections 302, 120B of the Indian Penal Code and 27 of Arms Act.

Allegation is that the accused persons with common intention have committed murder of the husband of the informant.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 26.02.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.37111 of 2019(2) dt.28-06-2019 2/2 against the petitioners. There is no eye witness to the alleged occurrence. The petitioners have been made accused in the present case merely on the basis of suspicion. Except for this, there is no other substantive evidence to suggest their implication in the present case. Both the petitioners are ladies. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saharsa in connection with Basnahi P.S. case No.33 of 2017 (Sessions Trial No.79 of 2018).
