This application is for grant of bail in connection with S.T. No.814 of 2014 arising out of Tarapur P.S.Case no.81 of 2000 for the offence under Sections 25 (1-B)A, 26 (2) and 35 of the Arms Act.
It is submitted on behalf of the petitioner that though it is alleged that there is recovery of a Pistol and another articles but there is nothing on the record to show as to how the police has got information about manufacturing of the Pistol at the joint house of the petitioner. The petitioner has been made accused in this case but he has not been arrested at the spot rather later on he has been arrested and he is in custody for about five months. Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.7994 of 2017 (2) dt.27-02-2017 2/2 bail.
Having heard both sides. Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail in the court below itself, after framing of the charges in this case.
With the aforesaid observation, this application is dismissed.
