Mr. Lalan Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2021 Heard Mr. Amresh Kumar Sinha, the learned counsel for the petitioner and Ms. Renuka Sharma, the learned counsel for the Central Government.
The petitioner seeks bail in connection with Special Case No. 64 of 2020, arising out of Didarganj P.S. Case No. 98 of 2020, instituted for the offences under Sections 8, 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
10 kgs. of Ganja is said to have been recovered from the possession of the petitioner.
The learned counsel for the petitioner has submitted that he is in custody since 06.05.2020 and up-
Patna High Court CR. MISC. No.37071 of 2020(4) dt.26-05-2021 2/2 till now, three witnesses have been examined and only one material witness is left to be examined.
Considering the quantum of recovery from the petitioner, I am not inclined to grant bail to him for the present.
The prayer for grant of regular bail of the petitioner is, accordingly, rejected.
However, looking at the custody of the petitioner and the fact that only one material witness is left to be examined, this Court directs that the trial be concluded positively within a period of six months to be counted from today. In case, there is no substantial progress in the trial within the aforesaid period, it would be open for the petitioner to approach the Trial Court for grant of bail and in that event, the Trial Court would be required to state reasons for non-conclusion of the trial.
The application stands disposed off accordingly. (Ashutosh Kumar, J) Praveen-II/- U T
